Terms of Service

These Terms of Service ("Terms") govern your access to and use of AfterWorn.com and all related subdomains, applications and services (together, the "Platform"), operated by AfterWorn Holdings ("AfterWorn", "we", "us"). By creating an account or using the Platform you agree to be bound by these Terms.

This document is a working template prepared to describe how the Platform operates. It is not legal advice and must be reviewed, completed and approved by a qualified lawyer admitted in the relevant jurisdictions (including Cyprus and any consumer-protection regimes applicable to AfterWorn's users) before the Platform is launched to the public.

1. Eligibility & Age Requirement

The Platform is an adult marketplace and is strictly restricted to adults. You may only access or use the Platform if you are at least 18 years of age, or the age of majority in your jurisdiction if higher, and if doing so is lawful where you live. By using the Platform you represent and warrant that you meet these requirements.

Minors are prohibited from accessing the Platform under any circumstances. We employ an age gate and human review of uploaded content to enforce this requirement; document-based identity verification is being added. AfterWorn is not available in jurisdictions where adult marketplaces are prohibited; we may geo-block access from such territories at our discretion.

2. Account Registration & Roles

To buy or sell you must register an account with a valid email address and create credentials. You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep it current.

Accounts carry one or more roles — buyer, seller, or both — and AfterWorn staff roles (admin, moderator, support). One natural person may hold only one account. Creating multiple accounts to evade limits, suspensions or fees is prohibited and detected through device-fingerprinting and risk scoring. We may enable two-factor authentication and recommend you do so.

3. Identity Verification (KYC)

Identity verification is not yet enabled on the Platform. It is planned through a verification partner across four tiers: Tier 1 (email and phone), Tier 2 (government ID and age confirmation), Tier 3 (ID plus selfie liveness check), and Tier 4 (Tier 3 plus proof of address and manual review).

Once verification is enabled, sellers will be required to complete Tier 2 before publishing any listing, Tier 3 will be required to unlock payouts above USD 500 per month, and Tier 4 will unlock the “Premium Verified” badge. Until then, publishing is gated by manual review of each listing by our team, and only the verification partner's submission identifier will ever be stored — identity documents themselves are never stored on AfterWorn systems. 4. Prohibited Items & Conduct

The following are strictly prohibited on the Platform:

  • Minors anywhere — no content involving, depicting or appealing to anyone under 18, in any form.
  • Bodily fluids or excretions — no sale of urine, feces, semen, blood or similar materials.
  • Non-consensual content — no content produced or shared without the full consent of all persons depicted.
  • Zoophilia — no content involving animals in a sexual context.
  • Doxxing or harassment — no publishing of others' private information, threats or targeted abuse.
  • Off-platform payment circumvention — no soliciting or arranging payment outside AfterWorn, and no sharing of external contact details or payment handles to evade the Platform.
  • Counterfeit goods, stolen property, weapons, controlled substances, or anything illegal in the buyer's or seller's jurisdiction.
  • Impersonation, fraud, scams, fake listings, AI-generated photos misrepresented as real items, or manipulation of reviews, trust scores or rankings.

Violations may result in immediate listing removal, account suspension or permanent ban, forfeiture of pending payouts pending investigation, and referral to law enforcement where required.

5. Seller Obligations

As a seller you agree to:

  • List only items you own and have the lawful right to sell, described truthfully and accurately.
  • Complete identity verification to at least Tier 2 once it is enabled, and keep the information accurate.
  • Use original photographs of the actual item; not misrepresent condition, wear or authenticity.
  • Ship within the stated handling time, package items hygienically and discreetly, and provide tracking.
  • Complete Proof of Wear when required (see Section 10) and respond promptly to buyer messages and disputes.
  • Comply with all tax obligations in your jurisdiction. AfterWorn provides an annual earnings export; tax filing is solely the seller's responsibility.

6. Buyer Obligations

As a buyer you agree to:

  • Pay only through the Platform; payment outside AfterWorn is unprotected and prohibited.
  • Provide an accurate shipping address and confirm receipt of orders promptly.
  • Communicate respectfully and keep all communication on-platform.
  • Use the dispute process in good faith and not abuse refunds, chargebacks or reviews.
  • Understand that all sales are of physical, intimate, used goods and final once delivered and accepted, subject to the dispute process.

7. Listing Rules

Every listing must accurately state the item, its condition, wear duration, price, shipping cost and handling time. Listings are screened by AI moderation and may be queued for human review. AfterWorn may edit, reject, pause or remove any listing that breaches these Terms, our content policy or applicable law. Featured or boosted placements are paid promotional services and do not constitute endorsement.

8. Payments, Membership & Payouts

On-platform payments are not yet enabled and no purchase can currently be paid for through the Platform. When payments launch they will be processed on-platform: funds paid by a buyer will be held by the Platform and will not be released to the seller until the order is completed.

AfterWorn takes no commission on sales. Sellers pay a membership fee to list and sell. Shipping charged by the seller is not subject to any platform fee.

On completion, funds are released to the seller's wallet — instantly for Premium members, and after a 7-day cooldown for free-tier sellers. Payouts to external accounts are subject to KYC tier, minimum thresholds and anti-fraud review.

9. Discreet Shipping

All items must be shipped in plain, unbranded outer packaging with no reference to AfterWorn or the contents. Use only display names in communication and ship discreetly with a neutral return name. Customs declarations must describe contents neutrally (for example "personal apparel" or "clothing sample"). Full requirements are in our Shipping Guide.

10. Proof of Wear

Proof of Wear (“POW”) is a planned verification step in which the seller submits a photo or short video of the worn item alongside the order code. It launches together with payments. POW will be mandatory when an order is USD 50 or more, when the seller is new or has limited reviews, or when the buyer requests it at checkout. Submitted media will be checked by our moderation pipeline (EXIF stripping, duplicate and stock-photo checks); automatic order-code reading (OCR) is not yet built and codes will be checked manually until it is. The buyer will then have a defined window to approve or reject; absent action, POW auto-approves. The shipping address will be revealed to the seller only after POW approval where POW is required.

11. Disputes & Refunds

If an order does not arrive, is materially not as described, or another problem arises, the buyer may open a dispute. Once payments are enabled, funds will be held by the Platform while a dispute is open. AfterWorn reviews the evidence submitted by both parties and may release the payment to the seller, refund the buyer in full or in part, or reach another resolution. Decisions by AfterWorn on disputes are final within the Platform. Abuse of disputes, refunds or chargebacks may lead to account action.

12. Reviews

After a completed order, buyers and sellers may leave reviews. Reviews must be honest, first-hand and based on the actual transaction. Fake, incentivized, retaliatory or manipulated reviews are prohibited. AfterWorn uses anti-manipulation measures and may remove reviews that breach these Terms.

13. Intellectual Property & User Content Licence

The AfterWorn name, logo, branding, software and original content are owned by AfterWorn Holdings and may not be used without permission. You retain ownership of content you upload (listings, photos, videos, stories, voice notes, reviews). By uploading content you grant AfterWorn a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display that content for the purpose of operating, promoting and improving the Platform. You represent that you hold all rights necessary to grant this licence.

14. Suspension & Termination

You may close your account at any time through your settings. AfterWorn may suspend, restrict or terminate any account that breaches these Terms, poses a fraud or safety risk, or where required by law. Where lawful and practical we will give notice and an opportunity to respond. On termination, pending order funds and payouts may be held while obligations and disputes are resolved. Provisions that by their nature should survive termination (including Sections 13, 15, 16 and 17) will survive.

15. Disclaimers & Limitation of Liability

AfterWorn is a venue that connects buyers and sellers; it is not the seller of items listed by users and does not take ownership of those items. The Platform is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, AfterWorn and AfterWorn Holdings will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our aggregate liability arising from or relating to the Platform is limited to the greater of the commission AfterWorn earned on the transaction giving rise to the claim, or USD 100. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer-protection rights.

16. Indemnification

You agree to indemnify and hold harmless AfterWorn, AfterWorn Holdings and their officers, employees and agents from any claims, damages, losses and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your transactions, or your breach of these Terms or applicable law.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Cyprus, where AfterWorn's operating base is located, without regard to conflict-of-law principles. The courts of Cyprus will have exclusive jurisdiction over disputes arising from these Terms, except where mandatory law grants you the right to bring proceedings in your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

19. Cookie Policy

AfterWorn uses cookies and similar technologies to operate the Platform and improve your experience. We group them into three categories, and you can manage your preferences through the cookie banner shown on your first visit and at any time thereafter.

  • Strictly necessary — required for core functions such as authentication, session security, CSRF protection and age confirmation. These cannot be switched off.
  • Analytics — help us understand how the Platform is used so we can improve it. Set only with your consent.
  • Marketing — used for relevant cross-promotion within the AfterWorn ecosystem. Set only with your consent.

You can withdraw or change consent at any time, and you can also control cookies through your browser settings. Disabling strictly necessary cookies may prevent the Platform from working. For how cookie data is processed, see our Privacy Policy.


Annex B

20. DMCA & Copyright Policy

AfterWorn respects intellectual property rights and responds to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws.

Filing a notice

If you believe content on the Platform infringes your copyright, send a written notice to our designated agent including: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the URL or precise location of the allegedly infringing material; (4) your contact details; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the rights holder.

Counter-notice

If your content was removed and you believe this was in error, you may submit a counter-notice with your signature, identification of the removed material and its prior location, a statement under penalty of perjury that removal resulted from mistake or misidentification, and your contact details and consent to jurisdiction.

Repeat infringers

AfterWorn maintains a repeat-infringer policy and will, in appropriate circumstances, disable or terminate the accounts of users who repeatedly infringe the rights of others.

Annex C

21. 18 U.S.C. § 2257 Compliance Statement

AfterWorn is committed to ensuring that every person depicted in any sexually explicit visual content available on the Platform was an adult of at least 18 years of age at the time the content was created.

To the extent that 18 U.S.C. § 2257 and § 2257A and their associated regulations apply, records required to be maintained for content uploaded to the Platform are kept by the Custodian of Records. Document-based age verification through a verification partner is planned but not yet enabled; until it is, uploading is limited to accounts that have confirmed they are 18 or over, and every uploaded image is reviewed by a person before it is published. Content depicting minors is strictly prohibited and is removed and reported.

AfterWorn primarily facilitates the sale of physical goods; where user-generated visual content falls within the scope of these record-keeping rules, compliance is maintained as described above.
